COPYRIGHT STATEMENT AND TERMS AND CONDITIONS OF USE

By purchasing you are agreeing and understanding what you are purchasing to the following terms and use:

Welcome to ArtWorks-Designs! All of the designs you see here are created by Luis De la Torre, and the copyright of all designs remain property of Luis De la Torre and ArtWorks Designs. Purchasing a design does NOT transfer ownership of said design. The design still belongs to Luis De la Torre and you are legally bound to abide by the terms and conditions listed.

 

RULES FOR MY DESIGNS:

⚠️ ALL ITEMS MUST BE MADE BY YOU. NO 3RD PARTY PRINTING ⚠️

 

  1. There are three types of DIGITAL files sold. Digital files include: Printable’s, TTF font rhinestone templates and SVG/Cut files. PLEASE read the descriptions of the designs carefully as there are NO refunds or exchanges on digital designs. The file type is listed several times, it is located in the title and description. If you are unsure as to which file you need please message me BEFORE purchase. Again THERE ARE NO REFUNDS IF YOU PURCHASE THE WRONG FILE TYPE.
     

  2. ✅ YES you MAY sell items that you have created using my designs. This includes shirts, cups, bags, etc. This does NOT include the sale of any transfer or decal. 🚫 You MAY NOT under any circumstances sell, share, give away, or trade my designs. 🚫 You MAY NOT mass produce anything using my designs. (More than 200 items, please contact me) Small commercial use is acceptable if you are unsure if you are mass producing feel free to contact me. 🚫 You are NEVER allowed to offer my designs on print on demand sites such as Zazzle, café press, Amazon Merch, or any other (POD) print-on-demand platforms. 🚫 You are NOT allowed to convert our designs into embroidery designs to sell digitally.
     

  3. 🚫 You are not allowed to sell transfers or decals of my designs without the proper extended license. Please contact me prior to purchase if this is your intent. UNDER no circumstances is it allowed that my artwork be sent to a 3rd party printer. Any sale of my designs as a transfer is strictly prohibited without the proper license.
     

  4. YES you can use the main product pictures with the ArtWorks SVG watermark on them. Watermark must be kept intact. If using ANY picture on this site you MUST have a watermark on it even if you have to add your own. Do NOT post any of my photos without a watermark.
     

  5. 🚫 NO you may not under any circumstances use any design or part of a design to create a new design you intend to sell in any digital format. This goes for the Printable alphabets as well. While I encourage you to make words, names, and teams you are NOT allowed to sell them in any digital format. Print them and press them on shirts to sell, ABSOLUTELY. Sell them as transfers, only with the proper license. Sell them digitally, NO.
     

  6. 🚫 ***YOU ARE NEVER ALLOWED TO SELL, SHARE, GIVE AWAY, OR TRADE MY DESIGNS*** This includes POD and 3rd party printing. If you are creating transfers YOU must be the one printing them. Sending them to a print shop is strictly prohibited. AND please remember you will need an extended license if you plan on selling the transfers you do print.
     

  7. 🚫 You may NOT resell, redistribute or share any of our designs or claim the design as your own. This includes selling printable templates to your own customers from your own online store (including but not limited to Etsy, Ebay, Amazon, or any general or digital design store).
     

  8. Luis De la Torre and ArtWorks Designs has the right to refuse service to anyone at any time. Improper use of any design is grounds for immediate account suspension. 
     

  9. PLEASE download your digital designs at the time of purchase. The website is not meant to be a storage locker for your digital designs, it is your responsibility to download them and save them for future use.

CUTTING FORMATS:
All cutting and printable files come in SVG, DXF, EPS, PDF and PNG formats. You must have a working knowledge of your machine and software to use these designs. I am not familiar with all machines and software, please refer to your user guide with questions about this.

 

FEEDBACK:

I love seeing all the things you create with my designs, feel free to add your pictures to your reviews. If for any reason you have a problem with a design please contact me, I will always do everything in my ability to fix the problem. I’m human and although I do use testers for my designs, on occasion an error will still slip through. 

 

CUSTOM DESIGN REQUEST:

I do offer custom designs when my to-do list allows it. Prices vary depending on the design. Please do not ask me to recreate something you have seen from another designer. I have my own designs and respect the work that others put into their designs and will not copy another’s work PERIOD.

 

CUSTOM-CUT FILE ORDERS SERVICES:

I do offer file conversion from a raster image to a vector file, so that’s means I will convert your logo or image to an SVG vectorized tracing files professionally that can be used in vinyl cutters like Cricut Design Space, Silhouette Studio, ScanNCut among others, or even for laser engraved and CNC machines. Custom items do take a little extra time to create. The tracing process for Custom cut file orders depends a lot on each image because every image has its own peculiarities, that’s why we have 5 different levels of complexity to offer. Once we receive the information you send us, we will set a price you can buy your item under the COMPLEXITY LEVEL drop-down list by selecting a level that I quoted you.

 

REFUNDS & EXCHANGES:

Due to the digital nature of the files on this page, I do not offer any type of exchange or refund. If you make a duplicate purchase of digital design you are welcome to contact me and swap it out with a different design. I do not offer exchanges or refunds on ANY Custom services. IF for some reason a refund is given through Pay-pal it will be minus Pay-pal fees. ArtWorks SVG reserves the right to charge a restocking fee on any purchase.

 

SHIPPING:

Digital Product: Instant download.

Physical products: Shipping prices are listed at time of checkout and include handling and processing. Handling and Processing include but are not limited to: Envelopes, packaging, labels, misc. product packaging and direct labor. These shipping prices will vary from time to time due to increased order numbers requiring extra direct labor. Shipping will not be combined for multiple purchases during sales. Shipping is non-refundable, please be aware of this prior to purchase.
